1. Agreement
These Terms of Service ("Terms") govern your access to and use of flexapply.org and the services provided by FlexApply ("we", "us", "our"). By using the site or purchasing a plan, you ("you", "the candidate") agree to these Terms. If you do not agree, do not use the service.
2. Service description
FlexApply provides job-application services on behalf of the candidate. Depending on the plan selected, services may include: tailoring resumes and cover letters, submitting applications to employers, facilitating internal referrals, contacting recruiters and HR professionals, and providing periodic tracking reports.
3. Eligibility
You must be at least 18 years old, legally able to enter contracts, and authorized to seek employment in the United States in the role categories you target. You are responsible for the accuracy of all information you provide regarding your work authorization and visa status.
4. Your content and authorizations
You grant us a limited license to use the materials and information you provide (resumes, cover letters, application data, account credentials where applicable) solely to deliver the service. You represent that all content you provide is accurate, owned by you, and lawful for us to use on your behalf. You authorize us to act as your agent for the purpose of submitting job applications and contacting potential employers and referral partners.
5. Payment and refunds
Plans are sold as one-time purchases at the prices shown on our Pricing page. Plans do not auto-renew. All sales are final and non-refundable. The trial plan is offered specifically so candidates can evaluate the service at lower cost before committing to a larger plan. By purchasing, you acknowledge and accept this no-refund policy.
6. Application terms and definitions
- An "application" is one submission to one role at one company.
- We may decline to apply to roles where you are clearly unqualified or where the application would be misleading.
- We may pause or stop a campaign if we determine continued submissions would harm your reputation or violate employer terms.
- Application volume is delivered over a reasonable period based on your target list and pace; tight visa timelines should be communicated at onboarding.
7. No guarantees of employment
We do not guarantee interviews, job offers, employment outcomes, visa sponsorship, or specific response rates. Hiring decisions are made solely by employers based on their own criteria. Internal referrals depend on employer policies and the availability of relevant contacts in our network. Not every company will receive a referral.
8. Acceptable use
You agree not to: provide false or misleading information; use the service for any unlawful purpose; misrepresent your eligibility for employment; or interfere with the operation of the service. You agree not to share or resell tracking reports, internal contacts, or other proprietary outputs of the service.
9. Limitation of liability
To the maximum extent permitted by law, FlexApply, its owners, employees, contractors and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost income, lost opportunities, immigration consequences, or reputational harm, arising out of or relating to the service. Our total aggregate liability shall not exceed the amount you paid us for the plan giving rise to the claim. Some jurisdictions do not allow these limits; in those jurisdictions our liability is limited to the maximum extent permitted by law.
10. Indemnity
You agree to indemnify and hold harmless FlexApply from any claims, damages, or expenses arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) inaccurate or misleading information you provided that we relied upon in delivering the service.
11. Termination
You may stop using the service at any time. We may suspend or terminate the service for any candidate who violates these Terms, provides fraudulent information, or whose campaign cannot be conducted in good faith. Sections that by their nature should survive termination (including limitations, indemnities, and disclaimers) will survive.
12. Governing law
These Terms are governed by the applicable laws of the United States. Any dispute arising from or relating to these Terms or the service will be resolved in courts of competent jurisdiction in the United States, and you consent to the jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date and, where appropriate, posted notice. Continued use of the service after changes take effect constitutes acceptance.
