1. Services Provided

FlexApply provides job application support services, including:

  • Resume review and optimization
  • Targeted job application submissions
  • Internal referral introductions where available
  • Cover letter customization
  • Application tracking and progress reporting

We do not guarantee job offers, interviews, or employment. Hiring decisions are made solely by employers.

2. Client Responsibilities

As a client, you agree to:

  • Provide accurate and truthful information about your background and qualifications
  • Submit a current, honest resume
  • Respond to employer communications promptly if you receive interview requests
  • Notify us of companies you do not want us to apply to
  • Pay for services as agreed upon
  • Not misrepresent your qualifications or work history

3. Payment Terms

  • Payment Required: Payment is due in full before we begin your campaign
  • Accepted Methods: Credit card, PayPal, Venmo, Zelle, or other agreed-upon methods
  • Non-Refundable: Payments are generally non-refundable once applications have been submitted
  • Prorated Refunds: If we cannot meet the agreed application count, we will provide a prorated refund
  • Pricing: Prices are as listed on our website and may change with notice for future purchases

4. Refund Policy

We offer limited refunds under the following conditions:

  • Before Work Begins: Full refund if requested before we start your campaign
  • Incomplete Service: Prorated refund if we cannot meet the agreed application count
  • After Completion: No refunds once all agreed applications have been submitted

We do not offer refunds based on:

  • Lack of interview requests or job offers
  • Employer response rates
  • Changes in your job search plans after work has begun
  • Dissatisfaction with market conditions or hiring trends

5. Service Limitations

You understand and agree that:

  • We cannot guarantee interviews, job offers, or employment
  • Employer response rates vary and are outside our control
  • Some companies may not respond to applications
  • Referrals are subject to availability and cannot be guaranteed for every company
  • We apply to positions that match your qualifications, but final selection is at our discretion
  • Application timelines may vary based on workload and job market conditions

6. Intellectual Property

  • Your Content: You retain ownership of your resume and personal information
  • Our Content: FlexApply retains ownership of our methods, processes, and website content
  • License: You grant us permission to use your information to provide services as described

7. Confidentiality

We maintain confidentiality of your information as described in our Privacy Policy. However, you understand that:

  • We must share your resume and information with employers to apply on your behalf
  • We may share professional information with referrers to facilitate introductions
  • Complete anonymity is not possible when applying to jobs

8. Prohibited Uses

You may not:

  • Provide false or misleading information
  • Use our services for fraudulent purposes
  • Request applications to companies where you have conflicts of interest
  • Attempt to reverse-engineer our processes or networks
  • Share your account access with others
  • Use our services in violation of any laws

9. Limitation of Liability

To the maximum extent permitted by law:

  • FlexApply is not liable for lost job opportunities or employment outcomes
  • Our total liability is limited to the amount you paid for services
  • We are not responsible for employer decisions, hiring processes, or response rates
  • We are not liable for indirect, incidental, or consequential damages

10. Disclaimer of Warranties

Services are provided "as is" without warranties of any kind. We do not warrant that:

  • Services will meet your specific expectations
  • Results will be obtained in any particular timeframe
  • Services will be uninterrupted or error-free
  • Any particular outcome will be achieved

11. Indemnification

You agree to indemnify and hold harmless FlexApply from any claims arising from:

  • False information you provide
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Disputes with employers

12. Termination

We reserve the right to terminate or suspend services if:

  • You violate these Terms
  • You provide false information
  • You engage in abusive or inappropriate behavior
  • Payment issues arise

You may cancel services before work begins for a full refund. Cancellation after work has started may result in fees for completed work.

13. Modifications to Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms. Significant changes will be communicated via email.

14. Dispute Resolution

  • Informal Resolution: Please contact us first to resolve any disputes
  • Arbitration: Disputes will be resolved through binding arbitration rather than court litigation
  • Class Action Waiver: You agree not to participate in class action lawsuits against FlexApply

15. Governing Law

These Terms are governed by the laws of the United States and the state where FlexApply operates, without regard to conflict of law provisions.
